Divorce

Any divorce can be difficult and can present emotional, legal and financial challenges for both parties. A divorce that involves high-assets will only exacerbate those problems and can make the issues surrounding divorce more difficult to resolve. A divorce that involves minor children presents its own set of issues, both emotional and financial, as well as a focus on the California standard of what really is in the best interests of the child. An experienced family law attorney at our firm can be a source of comfort and critical knowledge regarding such challenges. Our firm can also provide information and guidance regarding the tax issues that accompany a divorce, along with other family law issues.

Child Custody and Visitation

When children are involved, it takes responsibility and — in many situations — compromise to arrive at an agreement that protects the rights of the children and the parents. In addition to settlement and litigation, our firm uses Alternative Dispute Resolution (ADR), such as mediation, to help resolve issues of child custody and visitation. It takes an understanding of people, of family and of parent-child dynamics, as well as an understanding of all of the psychological issues presented by divorce for the parents and children. It requires being able to work with mental health professionals, dealing with the use of minor’s counsel, knowing when to reach out to other professionals, and when to use a full custody evaluation as opposed to a solutions-focused evaluation. In high-conflict cases, we are able to work with parenting counselors.

Spousal Support

Spousal support can be awarded by family courts when there is a substantial disparity in earning capacity between the spouses, or when one spouse needs support during a transitional period to maintain an appropriate standard of living. There are many other factors, however, that courts will use in determining the amount and the duration of the support. Understanding which factors are significant and how they should be best presented to the judge or mediator takes the experience-based knowledge and judgment of your attorney.

Property Division

In a high-asset divorce, the division of property and other marital assets can be difficult and can result in bitter disputes between the parties. It is important to fairly and accurately value the assets in question and to resolve issues of property division as efficiently and effectively as possible. California community property law is clear about how to divide property in principle, but it is very much open to interpretation, and often quite complicated, as to how to characterize property; whether and how much it is community property subject to division, or separate property belonging only to one spouse, or both. In some cases, complex issues come into play regarding intellectual property rights, business valuation, licensing agreements, and good will, among other things, all of which require the expertise and experience that Mr. Cohen provides. When accurately valuing assets, an attorney needs to understand accounting, work with CPAs, and be able to effectively cross exam the other party or the other party’s expert.

Post Judgment Modifications and Actions

After a divorce has been granted and all related issues, including custody and support, have been decided, circumstances may change for one or both ex-spouses. These changes may require modifications to divorce, custody or other agreements. If modifications cannot be achieved by agreement, new litigation may need to be pursued. Mr. Cohen is both experienced and highly skilled in handling such matters.
